What Is Contract Service in SOF and how is it regulated?

Contract service in the Special Operations Forces (SOF) is a specific form of military service under which servicemembers perform their duties based on the terms of a signed contract. This type of service is intended for motivated individuals who are ready to face physical, psychological, and professional challenges. Contract service is regulated by the Law of Ukraine “On Military Duty and Military Service”, as well as a number of regulatory legal acts that define the procedure for concluding contracts and the rights and obligations of servicemembers.
Contract Terms and Procedures
1. Contract Conclusion Process
Candidates for service in SOF undergo several stages of selection. These include medical examinations, physical fitness assessments, psychological testing, and specialized evaluations. After successfully completing the selection process, the candidate signs a contract that clearly defines the term of service, duties, and rights of the servicemember.
Contract Until Demobilization Is Announced
This type of contract is available only during martial law or mobilization in a special period. It is regulated by the Law of Ukraine “On Military Duty and Military Service” and is also available to individuals who were previously mobilized. The duration of such a contract directly depends on when demobilization is officially announced.
Fixed-Term Contract
Fixed-term contracts may also be signed during martial law. Contract durations range from 1 to 5 years, depending on rank and position. Initial contracts are concluded for the following terms:
3 years — for servicemembers appointed to enlisted positions;
3 to 5 years (by mutual agreement) — for servicemembers appointed to NCO and senior NCO positions;
5 years — for cadets who graduate from military educational institutions under programs preparing them for NCO and senior NCO service.
For officers, contract terms offer greater flexibility.
Specifically:
5 years — for servicemembers who graduated from higher military educational institutions under officer training programs;
2 to 5 years (by agreement) — for servicemembers who completed reserve officer training (military departments);
1 to 5 years — for other categories of officer personnel.
Contracts for Medical Personnel and Individuals Under 25 Years of Age
Legislation allows for 1-year contracts for the following categories:
Ukrainian citizens aged 18 to 25, provided they sign contracts for enlisted, NCO, or senior NCO positions (this does not apply to officers);
Ukrainian citizens with medical and/or psychological education who are appointed to contract positions in medical or psychological specialties.
Contract Content
A contract includes:
Description of service conditions (location, schedule, specifics of combat tasks);
Definition of social guarantees such as medical support, leave, and insurance;
Obligations to comply with orders and protect state secrets.
Candidate Requirements
To conclude a contract, candidates must:
Be Ukrainian citizens aged 18 or older;
Have satisfactory health and a high level of physical fitness;
Complete training or preparatory courses at designated training centers.
Obligations Under the Contract
1. Execution of Combat Missions
SOF servicemembers are required to perform complex tasks, including:
Participation in special operations;
Conducting reconnaissance missions behind enemy lines;
Ensuring the security of strategic facilities.
2. Compliance with Military Discipline
Contract service requires servicemembers to:
Execute commanders’ orders without objection;
Adhere to military ethics and professional conduct standards;
Maintain a high level of physical and professional readiness.
3. Participation in Training and Exercises
To maintain operational proficiency, servicemembers must regularly participate in training activities, including physical training, weapons instruction, tactical exercises, and combat simulations.
Rights Under the Contract
1. Social Guarantees
SOF servicemembers are entitled to:
Medical care, including treatment in specialized medical facilities;
Life and health insurance in the event of injury, disability, or death;
Compensation and benefits provided by law.
2. Fair Compensation
Financial support includes:
Base pay determined by rank, length of service, and specialization;
Additional payments for participation in combat operations or hazardous missions;
Compensation for overtime work and bonuses for successfully completed missions.
3. Right to Rest
Contract servicemembers are entitled to:
Annual paid leave, the duration of which depends on years of service;
Additional leave for family reasons or health-related issues.
How Is Contract Service Regulated?
1. Legislative Framework
Contract service is governed by:
The Law of Ukraine “On Military Duty and Military Service”;
Orders of the Ministry of Defense of Ukraine detailing service procedures;
International agreements, if servicemembers participate in peacekeeping operations.
2. Oversight of Contract Compliance
Compliance with contract terms is monitored by SOF command authorities. Disciplinary measures may be applied in cases of violations by servicemembers. If violations occur on the part of the command, servicemembers have the right to protect their interests through judicial and administrative mechanisms.
3. Contract Termination Mechanisms
A contract may be terminated at the initiative of the servicemember or the command in cases of:
Expiration of the contract term;
Failure of either party to fulfill contractual obligations;
Deterioration of health that prevents further service.
